USSC Hears US v Jones
Big Brother looking for permission to monitor your movements
This past Tuesday, the United States Supreme Court heard oral arguments in the case of United States v. Jones.
This case asks an important question: Is it OK for the police to (without a warrant) place a GPS device on your car and track your every movement.
In a larger sense, the question has become: Is it OK for the police to monitor EVERYONE’s car without a warrant.
The Supreme Court does not allow cameras in their courtroom, but they DO allow audio recording, which is broadcast on the C-Span program “America and the Courts”.
The audio of the oral arguments can be heard here, and provides an interesting look into how the courts operate.
First: this is not the way courts operate when you watch Perry Mason or Court TV. The attorneys are constantly interrupted by the judges who ask them complex and obscure questions relating (not only) to their case but also to the long-term effect that judgment in either direction might have on the future.
It’s also interesting to hear how the judges will argue both sides of the issue. When you first listen to the justices arguing with the attorney representing the United States, you think they are on the side of the defendant. But as soon as his attorney gets up, they pound on him just as hard and question his arguments just as deeply.
If you’re a Supreme Court junkie/fan as much as I am, oral arguments are a fascinating look into the court and their methods. There is humor, laughter, pithy comments, and everything you think you wouldn’t expect in a court.
For example, when one judge questions whether it is right in a free society for the police to track all of its citizens, you can hear another justice in background saying ‘live free or die’.
As brought out in the arguments, this case creates possible room for abuse.
For example: if found in favor of the government, the police can put a device on your car and track you. If they find that you have been speeding in the last 28 days, they can use that as probable cause to stop you and search your car. What they find at that point is your problem.

This will be just the begining . I can assure u Mr.Malcolm there won’t be many comments about this topic posted every1 is concerned with REAL issues like what’s Beyonce’s baby gender or y Kim K is being cast in a Tyler Perry movie Lol . Maybe me and a few otherz r really concerned about what Big Bother xxxcuse me Big Brother Government will be try’n 2 pull. It is going 2 happen within the next 10 yrs slowly but surely 4 the sake of “National Security”. I still watch Enemy Of the State with Will Smith and that came out in 1999 deep ass movie. I suggest every1 pay real close attention 2 ur Government ask questions and don’t just or go along with it. Occupy “Big Bother” I meant Big Brother AmeriKKKa .
I’m sorry to inform you, you are already being monitored. The ring of steel they are building in NY (which is the upgrade of an already existing city-wide camera system), cell phone records (tracking your movements from tower to tower), internet cookies, Metrocard swipes, on board automobile computers, they are all monitoring every second of your life. These precedings are just the arguement of it’s constitutionality and whether such data could be used to convict in case of a crime. Whether its good or bad? I dont know. Usually everything is OKAY until its used against me, LOL!!!!
So, keep your nose VERY clean folks and hope you dont get caught.

Actually its a litle sneakier than that. Speeding is not probable cause to search your vehicle. A search warrant is still needed and they can detain you until a warrant is signed, for the smarty pants out there. BUT, Now if they were performing “random” stops, and checked the monitoring system and found that you frequented a location known for the distribution or sale of drugs they could use that as probable cause for a search. And that location could be as vague as a certain part of town, saaaaay an entire public housing complex that you happen live at….
Recently police set up a random stop with an easy rule… only pull over the people who see it and turn around.
Speeding is not probable cause but being black is enough matter fact it’s a federal offense 2 be black and educated about the Slim Shady shit that goes on within the “Big Bother” I meant Big Brother way of doing things.I know it has been going on read about George Orwells 1984 book just peep the last 10 yrs.
I was listening to another case where the police would go into housing complexes ‘known’ for drug dealing. They walk down the hall and knock on all doors. If they hear a toilet flush, they take that as a sign that someone is flushing drugs, and kick the door in.
That could be seen a probable cause for search. The line is VERY thin and the area is VERY gray.
This should be an easy one: The Constitution is supposed to protect us from illegal searches. But, people with power do whatever they want because they make the rules. The Patriot Act should be unconstitutional. It’s being used right now to illegally monitor/search/detain people and break a bunch of other rights/laws. So the gov’t will probably win this one too. The supreme court should be renamed the Kangaroo Court! It’s a tool for the gov’t and the 1%…
I agree, but in listening to the arguments at the court, it gets more complex.

For example: as one justice pointed out: since your license plate is technically owned by the state and driving is considered a privilege, they could put a tracer on your license plate without it being either a search or a seizure.
Right. And you know what will happen to you if you drive an unregistered vehicle: car will be inpounded and you are going to jail! So, they have us either way! Again, they make the rules.
Welcome 2 1 world government!! Ur so E.L. Governments make the rules 4 them 2 break yet enforce on it’s people.
