‘Freeway’ Ricky Ross’ Trademark Infringement Suit Against Rick Ross Dismissed

Judge says “Illegal Activity” can’t be used to establish a trademark

A California court Judge yesterday dismissed a $10 million trademark infringement lawsuit filed by former Los Angeles drug boss “Freeway” Ricky Ross alleging that rapper Rick Ross profited off his moniker.  The judge dismissed the suit filed in May citing that his moniker did not have “secondary meaning” and value in commerce from drug dealing.  The dismissal comes on the heals of a failed injunction filed by the ex-con to stop the release of the rapper’s recent critically acclaimed “Teflon Don” album.

“In support of his trademark claims, Plaintiff alleges that his name was well known in the drug trade and by law enforcement segments of the urban crime, rap and black comity because he did business as Rick Ross, until he was arrested, prosecuted and incarcerated in federal prison,” said the court.  “Because this illegal activity cannot be used to establish secondary meaning, such allegations do not provide support for Plaintiff having a valid trademark for his name.”

Freeway Ricky Ross must file an appeal within 30 days.  The former kingpin got his “Freeway” name from the homes he owned along Southern California’s Harbor Freeway.  Ross was released in May 2009 after serving a 20 year bid for orchestrating a criminal enterprise that pumped hundreds kilos of cocaine per month earning $2 million EVERY DAY in PROFIT!  I guess he paid the cost to be the boss.  20 years of your life is a hefty fine though.

    Ex fake drug dealers tries to sue current ex fake drug dealing rapper. Interesting. Rick Ross should just make his own money, since he got out and he has freedom. Use it brother.
