Jay-Z Sues David Ortiz For Biting ’40/40′: Is ‘Big Papi’ More Entitled to the Name?

While much of Jay-Z’s empire he owes to his accomplishments in music he has also experienced success in other arenas like Fashion and namely his his chain of 40/40 club sports bar lounges.  The upscale sports bars located in Atlantic City and Las Vegas with future locales to come to Tokyo and Macau are cleverly named after one of baseball’s “most elite clubs,” the 40 home run, 40 stolen base club.  As with this any any prominent brand its important to protect it and that’s what Jay-Z and business partner Juan Perez (no not me, he’s got more dough) did when the decided to sue Boston Red Sox Slugger, David Ortiz for a rumored $5 Million in damages for opening a club of the same name in his native country (and mine) the Dominican Republic.  Jay-Z is accusing Ortiz, who fans affectionately call Big Papi of trading on the fame, value and goodwill of their respected name which according to them has caused their business “marketplace confusion and damage.”

But here’s the thing, Papi at least plays baseball.  On the other hand Ortiz although known for his power has very little speed and has never stolen more than 10 bases in a year.  The whole lawsuit however does make you wonder why Major League Baseball who is very protective of its trademarks never sued Jay-Z  for t infringement.  None the less it begs the question, Who should really lay claim to the name 40/40?  Hov, Papi or Major League Baseball?  SOUND OFF.

    I think Jay-Z and the fake JC need to get over it. He opened the club in DR. It’s not even in the states…quit your bitching. Next time pay the few hundred for copyright

        There’s 40/40′S in Tokyo and I doubt you could copyright the term 40/40. That’s like saying you should copyright triple double or any other sports refrence. For Big Papi to open up a nightclub and call that shit 40/40 is stupid. Where’s your lawyers @ dude. If he had opened a barber shop or some other business and called it 40/40 thats different but a club, come on man thats blatant stelaing.

    Word!! My first thought was “it’s not in the United States”. Sorry Jay-Z, but if you are suing for damages “good luck” but if you are suing for publicity then GOOD GOING because the press is talking about it.
